SBE to hear Miller polling complaint.

Bob Gibson: SBE to consider a complaint against the Miller campaign’s polling practices. I don’t understand why the SBE would hear this—do they have any jurisdiction in a federal election?

  1. I think they do, Waldo, but we should probably get somebody who’s a little more experience that myself to answer that one.

  2. I’m obviously no lawyer, but would hazard a guess that Hartnett’s complaint comes under “>§ 24.2-1014.1, which requires that Miller disclose that he’s making the calls (with a $2500 fine or a Class 1 misdemeanor at the other end).

    Since it’s under state law, I think complaints have to be filed to the SBE (§ 24.2-929).
